The data protection declaration of Printing for Business GmbH is based on the terms used by the European legislator for directives and regulations when the basic data protection regulation (DS-GVO) was issued. Our data protection declaration should be easy to read and understand for the public as well as for our customers and business partners. To ensure this, we would like to explain the terms used in advance.

We use the following terms, among others, in this data protection declaration:

a) personal data

Personal data is any information relating to an identified or identifiable natural person (hereinafter “data subject”). g) Controller or data controller

Controller or data controller is the natural or legal person, public authority, agency or any other body which alone or jointly with others determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union law or by the law of the Member States, the controller or the specific criteria for its designation may be provided for by Union law or by the law of the Member States.

h) Processor

Processor is a natural or legal person, public authority, agency or other body that processes personal data on behalf of the controller.

i) Recipient

The recipient is a natural or legal person, authority, institution or other body to whom personal data is disclosed, whether or not it is a third party. However, public authorities which may receive personal data in the course of a specific investigation mandate under Union or national law shall not be considered as recipients.

j) Third party

A third party is a natural or legal person, public authority, agency or body other than the data subject, the controller, the processor and the persons who, under the direct authority of the controller or the processor, are authorized to process the personal data.

k) Consent

Consent is any freely given, informed and unequivocal expression of the data subject’s will in a specific case, in the form of a declaration or other unequivocal affirmative act by which the data subject signifies his or her consent to the processing of personal data relating to him or her.

The website of Printing for Business GmbH collects a number of general data and information every time the website is accessed by a person concerned or by an automated system. The (1) browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system accesses our website (so-called referrer), (4) the sub-websites that are accessed via an accessing system on our website, (5) the date and time of an access to the Internet site, (6) an Internet protocol address (IP address), (7) the Internet service provider of the accessing system and (8) other similar data and information which serve to prevent danger in the event of attacks on our information technology systems.

When using this general data and information, Printing for Business GmbH does not draw any conclusions about the person concerned. Rather, this information is required (1) to deliver the contents of our website correctly, (2) to optimize the contents of our website and the advertising for it, (3) to ensure the permanent operability of our information technology systems and the technology of our website, and (4) to provide law enforcement agencies with the information necessary for prosecution in the event of a cyberattack. These anonymously collected data and information are therefore evaluated by Printing for Business GmbH on the one hand statistically and also with the aim of increasing data protection and data security in our company, in order to ultimately ensure an optimum level of protection for the personal data processed by us. The anonymous data of the server log files are stored separately from all personal data provided by a person concerned.

6. Subscription to our newsletter

On the website of Printing for Business GmbH, users are given the opportunity to subscribe to the newsletter of our company at www.pfb.de/solutions. The input mask used for this purpose indicates which personal data is transferred to the person responsible for processing when ordering the newsletter.

Printing for Business GmbH informs its customers and business partners at regular intervals by means of a newsletter about offers of the company. In principle, the newsletter of our company can only be received by the data subject if (1) the data subject has a valid e-mail address and (2) the data subject registers to receive the newsletter. For legal reasons, a confirmation e-mail will be sent to the e-mail address registered for the first time by a person concerned for the purpose of receiving the newsletter using the double opt-in procedure. This confirmation mail is used to check whether the owner of the e-mail address has authorized the receipt of the newsletter as the person concerned.

When registering for the newsletter, we also save the IP address assigned by the Internet Service Provider (ISP) of the computer system used by the person concerned at the time of registration as well as the date and time of registration. The collection of this data is necessary in order to be able to trace the (possible) misuse of a data subject’s e-mail address at a later date and therefore serves to provide legal protection for the data controller.

The personal data collected during registration for the newsletter is used exclusively for sending our newsletter. In addition, subscribers to the newsletter could be informed by e-mail if this is necessary for the operation of the newsletter service or for registration, as might be the case if there are changes to the newsletter offer or if technical conditions change. The personal data collected within the scope of the newsletter service will not be passed on to third parties. The subscription to our newsletter can be cancelled by the person concerned at any time. The consent to the storage of personal data, which the person concerned has given us for the newsletter service, can be revoked at any time. For the purpose of revoking the consent, a corresponding link is included in every newsletter. It is also possible to unsubscribe from the newsletter at any time directly on the website of the data controller or to inform the data controller in another way.

7. Newsletter tracking

The newsletters of Printing for Business GmbH contain so-called counting pixels. A tracking pixel is a miniature graphic embedded in such e-mails sent in HTML format to enable log file recording and log file analysis. This enables a statistical evaluation of the success or failure of online marketing campaigns. By means of the embedded pixel-code, Printing for Business GmbH can recognize whether and when an e-mail was opened by a person concerned and which links contained in the e-mail were called up by the person concerned.

Such personal data collected via the pixel-code contained in the newsletters is stored and evaluated by the data controller in order to optimize the newsletter dispatch and to adapt the content of future newsletters even better to the interests of the data subject. This personal data is not passed on to third parties. Affected persons are entitled to revoke the separate declaration of consent submitted in this regard via the double opt-in procedure at any time. After revocation, these personal data will be deleted by the data controller. Printing for Business GmbH automatically interprets a cancellation of the receipt of the newsletter as a revocation.

8. Contact possibility via the Internet site

Due to legal regulations, the Internet site of Printing for Business GmbH contains information that enables rapid electronic contact with our company as well as direct communication with us, which also includes a general address for so-called electronic mail (e-mail address). If a data subject contacts the data controller by e-mail or via a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data transmitted voluntarily by a data subject to the data controller are stored for the purposes of processing or contacting the data subject. This personal data is not disclosed to third parties. 

9. Comment function in the blog on the website

Printing for Business GmbH offers users the possibility to leave individual comments on individual blog posts on a blog located on the website of the data controller. A blog is a portal on a website, usually open to the public, where one or more people, called bloggers or web bloggers, can post articles or write down thoughts in so-called blog posts. The blog posts can usually be commented by third parties.

If a person concerned leaves a comment in the blog published on this website, in addition to the comments left by the person concerned, information on the time of the comment entry as well as the user name (pseudonym) chosen by the person concerned are stored and published. Furthermore, the IP address assigned to the person concerned by the Internet Service Provider (ISP) is also logged. This storage of the IP address is done for security reasons and in the event that the person concerned violates the rights of third parties or posts illegal content through a comment submitted. The storage of this personal data is therefore in the own interest of the person responsible for the processing, so that he/she could be exculpated in case of a violation of the law. The personal data collected will not be passed on to third parties, unless such a transfer is required by law or serves the legal defense of the person responsible for processing.

10. Subscription to comments in the blog on the website

Comments made in the Printing for Business GmbH blog can be subscribed to by third parties. In particular, it is possible for a commentator to subscribe to the comments following his or her comment on a specific blog entry.

If a data subject chooses the option of subscribing to comments, the data controller sends an automatic confirmation e-mail in order to check in a double opt-in procedure whether the owner of the e-mail address specified has actually chosen this option. The option to subscribe to comments can be cancelled at any time.

11. Routine deletion and blocking of personal data

The data controller processes and stores personal data of the data subject only for the time necessary to achieve the purpose of storage or if this is provided for by the European Directive and Regulation Giver or another legislator in laws or regulations to which the data controller is subject.

If the purpose of storage ceases to apply or if a storage period prescribed by the European Directive and Regulation Giver or any other competent legislator expires, the personal data will be blocked or deleted as a matter of routine and in accordance with the law.

12. Rights of the data subject

a) Right to confirmation

Every data subject has the right, granted by the European Directives and Regulations, to obtain confirmation from the controller as to whether personal data relating to him are being processed. If a data subject wishes to exercise this right of confirmation, he or she may at any time contact an employee of the data controller.

b) Right of access

Every person affected by the processing of personal data has the right, granted by the European Directive and Regulation Giver, to obtain at any time and free of charge information from the data controller about the personal data stored about him and a copy of this information. Furthermore, the European Directive and Regulation Giver has granted the data subject access to the following information:

– the processing purposes

– the categories of personal data processed

– the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular to recipients in third countries or to international organizations

– if possible, the planned duration for which the personal data will be stored or, if this is not possible, the criteria for determining this duration

– the existence of a right of rectification or erasure of personal data relating to him or her or of a right of opposition to or limitation of the processing by the controller

– the existence of a right of appeal to a supervisory authority

– if the personal data are not collected from the data subject: All available information about the origin of the data

– the existence of automated decision-making, including profiling, in accordance with Article 22(1) and (4) of the DPA and, at least in these cases, meaningful information about the logic involved and the scope and intended impact of such processing on the data subject

Furthermore, the data subject has the right of information as to whether personal data has been transferred to a third country or to an international organization. If this is the case, the data subject shall also have the right to obtain information on the appropriate safeguards in connection with the transfer.

If a data subject wishes to exercise this right of access, he or she may at any time contact an employee of the controller.

c) Right of rectification

Every person affected by the processing of personal data has the right, granted by the European Directives and Regulations, to request the immediate rectification of incorrect personal data concerning him. Furthermore, the data subject has the right to request the completion of incomplete personal data, also by means of a supplementary declaration, taking into account the purposes of the processing.

If a data subject wishes to exercise this right of rectification, he or she may at any time contact an employee of the data controller.

d) Right of cancellation (right to be forgotten)

Any person affected by the processing of personal data has the right, granted by the European Directives and Regulations, to obtain from the controller the immediate deletion of personal data concerning him/her, if one of the following reasons applies and if the processing is not necessary:

– The personal data have been collected or otherwise processed for purposes for which they are no longer necessary.

– the data subject withdraws the consent on which the processing was based pursuant to Article 6(1)(a) of the DPA or Article 9(2)(a) of the DPA, and there is no other legal basis for the processing

– The data subject lodges an objection to the processing pursuant to Art. 21(1) DPA and there are no overriding legitimate reasons for the processing, or the data subject lodges an objection to the processing pursuant to Art. 21(2) DPA.

– The personal data were processed unlawfully.

– The deletion of the personal data is necessary to comply with a legal obligation under Union law or the law of the Member States to which the controller is subject.

– The personal data was collected in relation to information society services offered in accordance with Art. 8 Paragraph 1 DS-GVO.

If one of the aforementioned reasons applies, and a data subject wishes to arrange for the deletion of personal data stored by the Printing for Business GmbH, he or she may, at any time, contact any employee of the controller. The employee of the Printing for Business GmbH will arrange for the erasure request to be complied with immediately.

If the Printing for Business GmbH has made the personal data public and our enterprise as the controller is obliged to delete the personal data pursuant to Article 17 (1) of the Data Protection Regulation, the Printing for Business GmbH shall implement reasonable measures, including technical measures, to ensure that other data controllers process the published personal data and that the data subject has requested from those other data controllers to delete all links to or copies or replications of the personal data, unless the processing is necessary. The employee of the Printing for Business GmbH will arrange the necessary in individual cases.

e) Right to restriction of processing

Each data subject concerned by the processing of personal data has the right, granted by the European Directive and Regulation, to obtain from the controller the restriction of processing if one of the following conditions is met:

– The accuracy of the personal data is contested by the data subject for a period enabling the controller to verify the accuracy of the personal data.

– The processing is unlawful, the data subject objects to the erasure of the personal data and requests instead the restriction of the use of the personal data.

– The controller no longer needs the personal data for the purposes of the processing, but the data subject needs it for the assertion, exercise or defense of legal claims.

– The data subject has objected to the processing pursuant to Article 21 (1) of the GDPR and it is not yet clear whether the legitimate grounds of the controller override those of the data subject.

If one of the aforementioned conditions is met, and a data subject wishes to request the restriction of personal data stored by the Printing for Business GmbH, he or she may, at any time, contact any employee of the controller. The employee of the Printing for Business GmbH will arrange the restriction of the processing.

f) Right to data portability

Any data subject concerned by the processing of personal data has the right, granted by the European Directive and Regulation, to obtain personal data concerning him or her, which has been provided by the data subject to a controller, in a structured, commonly used and machine-readable format. He or she also has the right to transmit such data to another controller without hindrance from the controller to whom the personal data have been provided, provided that the processing is based on consent pursuant to Article 6(1)(a) of the GDPR or Article 9(2)(a) of the GDPR or on a contract pursuant to Article 6(1)(b) of the GDPR and the processing is carried out by automated means, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Furthermore, when exercising the right to data portability pursuant to Article 20(1) of the GDPR, the data subject shall have the right to obtain that the personal data be transferred directly from one controller to another controller where technically feasible and provided that this does not adversely affect the rights and freedoms of other individuals.

In order to assert the right to data portability, the data subject may at any time contact any employee of the Printing for Business GmbH.

g) Right to object

Any person affected by the processing of personal data has the right granted by the European Directive and Regulation to object at any time, on grounds relating to his or her particular situation, to the processing of personal data concerning him or her which is carried out on the basis of Article 6(1)(e) or (f) of the DS-GVO. This also applies to profiling based on these provisions.

The Printing for Business GmbH shall no longer process the personal data in the event of the objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the assertion, exercise or defence of legal claims.

If the Printing for Business GmbH processes personal data for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data processed for such marketing. This also applies to the profiling, insofar as it is related to such direct marketing. If the data subject objects to the Printing for Business GmbH to the processing for direct marketing purposes, the Printing for Business GmbH will no longer process the personal data for these purposes.

In addition, the data subject has the right, on grounds relating to his or her particular situation, to object to processing of personal data concerning him or her which is carried out by the Printing for Business GmbH for scientific or historical research purposes, or for statistical purposes pursuant to Article 89(1) of the Data Protection Regulation (DS-GVO), unless such processing is necessary for the performance of a task carried out in the public interest.

In addition, the data subject is free to exercise his/her right to object by means of automated procedures using technical specifications in connection with the use of information society services, notwithstanding Directive 2002/58/EC.

h) Automated decisions in individual cases, including profiling

Any data subject concerned by the processing of personal data shall have the right, granted by the European Directive and Regulation, not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her, unless the decision (1) is necessary for entering into, or the performance of, a contract between the data subject and the controller, or (2) is permitted by Union or Member State law to which the controller is subject and that law contains suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, or (3) is made with the data subject’s explicit consent.

If the decision (1) is necessary for entering into, or the performance of, a contract between the data subject and the data controller, or (2) it is made with the data subject’s explicit consent, the Printing for Business GmbH shall implement suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, which include at least the right to obtain the data subject’s involvement on the part of the controller, to express his or her point of view and to contest the decision.

If the data subject wishes to exercise the rights concerning automated decisions, he or she may, at any time, contact any employee of the controller.

i) Right to withdraw consent under data protection law

Any data subject concerned by the processing of personal data has the right, granted by the European Directive and Regulation-maker, to withdraw consent to the processing of personal data at any time.

If the data subject wishes to exercise the right to withdraw consent, he or she may, at any time, contact any employee of the controller.

13. Data protection during applications and in the application process

The controller collects and processes the personal data of applicants for the purpose of handling the application procedure. The processing may also be carried out electronically. This is particularly the case if an applicant submits relevant application documents to the controller by electronic means, for example by e-mail or via a web form located on the website. If the controller concludes an employment contract with an applicant, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions. If the controller does not conclude an employment contract with the applicant, the application documents will be automatically deleted two months after notification of the rejection decision, provided that no other legitimate interests of the controller conflict with such deletion. Other legitimate interest in this sense is, for example, a duty to provide evidence in proceedings under the General Equal Treatment Act (AGG).

Each time one of the individual pages of this website operated by the data controller is called up and on which a Facebook component (Facebook plug-in) has been integrated, the Internet browser on the information technology system of the data subject is automatically caused by the respective Facebook component to download a representation of the corresponding Facebook component from Facebook. Within the scope of this technical procedure, Facebook receives knowledge of which specific sub-page of our website is visited by the data subject.

The controller uses the addition “gat. anonymizeIp” for web analysis via Google Analytics. By means of this additive, the IP address of the Internet connection of the data subject is shortened and anonymized by Google if access to our Internet pages is from a Member State of the European Union or from another State party to the Agreement on the European Economic Area.

The purpose of the Google Analytics component is to analyze the flow of visitors to our website. Among other things, Google uses the data and information obtained to evaluate the use of our website, to compile online reports for us showing the activities on our website, and to provide other services related to the use of our website.

Google Analytics sets a cookie on the information technology system of the data subject. What cookies are has already been explained above. By setting the cookie, Google is enabled to analyze the use of our website. By each call of one of the individual pages of this website, which is operated by the controller and on which a Google Analytics component has been integrated, the internet browser on the information technology system of the data subject is automatically caused by the respective Google Analytics component to transmit data to Google for the purpose of online analysis. If one of the aforementioned reasons applies, and a data subject wishes to arrange for the deletion of personal data stored by the Printing for Business GmbH, he or she may, at any time, contact any employee of the controller. The employee of the Printing for Business GmbH will arrange for the erasure request to be complied with immediately.

How can I delete my data or prevent it from being saved?

Cloudflare stores data logs only as long as necessary. In most cases, this data is also deleted again within 24 hours as well. However, there is information that Cloudflare saves as part of its permanent log for an indefinite time period in order to improve the overall performance of Cloudflare Resolver and identify any security risks.
